How will my property be divided after my Miami divorce?

Florida Statute Section 61.075, "Equitable distribution of marital assets and liabilities," sets out how property will be divided after a Miami divorce. The statute says: "In a proceeding for dissolution of marriage, the court shall set apart to each spouse that spouse's nonmarital assets and liabilities, and in distributing the marital assets and liabilities between the parties, the court must begin with the premise that the distribution should be equal, unless there is a justification for an unequal distribution based on all relevant factors."

What this means is that all property bought by one spouse before the marriage is considered nonmarital, and that spouse gets to keep it. All property bought during the marriage, however, is considered marital. Anything that is marital will be divided equally between the spouses during the divorce proceedings.
