We explain that no one, not even family law attorneys that have been practicing in Pennsylvania for over 20 years, can be sure up front exactly how much any Pittsburgh divorce or Allegheny County child support case is going to cost before even hearing the facts of the case.
Another thing they are always sure to ask once they do hire us to represent them in their dispute is how to make the other side pay their lawyer’s fees. The answer to this question is just as complicated and depends, again, on the circumstances of each individual case. There is never a guarantee that a party will be able to get attorney’s fees, but when there is a possibility, we of course always try to obtain that relief for our clients.
Situations in which awarding attorney’s fees is most possible is when there is an income disparity between parties to a Pennsylvania divorce. If, for example, the soon to be ex-wife is a doctor in private practice and the husband works as a mechanic, the likely difference in income level between these two professions may warrant an award of attorney’s fees. But again, there is no guarantee; it is up to the Allegheny County family law judge to make the final decision.
