Non-Immigrant Visas

Last year the United States had close to seventy million foreign visitors. This number represents that almost seventy million nonimmigrant visas were obtained. The country’s immigration laws distinguish between immigrant visas, for foreign nationals that seek to make the United States their permanent place of residence, and nonimmigrant visas, for those seeking temporary admission into the country.

When a person seeks to enter the United States an immigration officer will determine their eligibility to enter the country and the duration for their period of stay. This is then documented on a I-94 Form that is attached to the person’s passport. The I-94 form contains the information of the type of visa category the person obtained and the last date that the person may lawfully remain in the United States. There are a number of different nonimmigrant visas that can be obtained, such as opening a business, working, studying, and visiting.

Once the immigrant is within the country they may apply to change to another nonimmigrant category or petition to extend the length of their stay. The duration of the nonimmigrant visa can range from a few days to up to five years. There is also a possibility to apply for permanent residence by changing your status from a nonimmigrant to an immigrant.
