Section 61.29 of the Florida Statutes establishes that each parent has a fundamental obligation to support his or her minor children. In this regard, if a parent has voluntarily quit their employment or is otherwise voluntarily unemployed or underemployed, the Family Court will assess an earning capacity to that parent. Furthermore, absent credible evidence on the unemployed or underemployed parent’s earning capacity, the court shall impute income to that parent equal to the median income of a year-round, full-time employee from current population reports in the Bureau of Census.
