Surrogacy Law By State: Pennsylvania Is Surrogacy Friendly

Surrogacy law varies state by state across the United States and is constantly changing. While Pennsylvania is considered to be a surrogacy friendly state, this is not true of every state. Below is a list of those states considered to be surrogacy friendly and those states that are not;

Surrogacy Friendly States

Alabama, California, Colorado, Connecticut, D.C., Delaware, Florida, Georgia, Hawaii, Illinois, Kansas, Maine, Maryland, Massachusetts, Missouri, Montana, Nevada, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Texas, Utah, Vermont, Wisconsin, West Virginia

Not So Friendly Surrogacy States

Alaska, Arizona, Indiana, Iowa, Idaho, Kentucky, Louisiana, Mississippi, Montana, Nebraska, Michigan, New Jersey, New York, Tennessee, Virginia, Washington, Wyoming

Of those states that are recognized as friendly toward the surrogacy procedure, some are more friendly than others. Likewise, of those listed as being unfriendly toward surrogacy, some states simply have inconsistent legal results pertaining to those court cases that have been heard while others prohibit compensated surrogacy contracts or birth certificates naming both parents.
